My car was totalled when I got rear-ended. How do I get the best price for it from the insurance company?

The accident was the other guy's fault (in California). The insurance company chose to total it and pay me, rather than have it fixed. But the price they are quoting me is very low, lower than Kelley Blue Book and lower than asking prices in local classifieds. They say they use their own program, but I can't replace what I had with the amount they are offering. What rights do I have and is there anything I can do to get that offer up?

I don't know what to do, I know it was completely idiotic driving without a license, and no permit, with no insurance, but my friend has insurance on the car. I have the police report, and I don't know what I have to do, but I will help him with anything as this is my best friend, and I am not straying away from this situation. Alright. I am in desperate need of some knowledge. I just graduated from high school and live in Idaho with my boyfriend and his parents. The majority of my driving will be errands around town, and driving the 117 miles back home occasionally to visit family. Low insurance, high gas mileage, and safety are top priorities. I've got about $15,000 to spend on the car. I will have a part time job to pay insurance/gas/etc. So far the only car that appeals to me is the 2010+ Mazda3 because it has a nice exterior, and I love the interior and features compared to other small cars. Gas mileage is decent, but not the best. Also, if I go for the hatchback, will that raise my insurance costs? Do you have any other recommendations? The Mazda3 has the best interior that I've seen so far, that's the basic factor that's keeping me from other cars.

My wife and I are in our 40's and 50's. We have created A/B trusts and transferred our assets to them, and expect to have estates that will benefit from the estate tax saving these trusts afford. We recently both purchased $1M 10-year renewable term life insurance policies that we expect to keep for 10 years. We chose not to use life insurance trusts because the purpose of the policies is to replace the lost income of the deceased spouse if one of us dies relatively soon, not to increase our final estate, and the trusts are somewhat costly. We each specified our own trusts as the beneficiaries, because we want the disposition of assets specified there to be used for this money. The trusts provide for the income, and principle if needed, to be paid to the spouse, and for the remainder to be paid to our child at the remaining spouses death. The question of ownership of the policies is less clear. My lawyer says that it doesn't make much difference who owns them, because the value (estate) taxed is only one year's premium, not the $1M. My accountant says that the $1M is taxed, and that each policy should be owned by the other spouse to avoid tax on that amount. A friend said that there's no way to avoid or significantly decrease the tax, so just leave the ownership as is (each spouse owns their own policy). A further fly in the ointment is that the insurance company (Massachusetts SBLI) makes some forms of trust ownership more difficult and costly. I'm confused. What ownership is the best? Wouldn't the PPAC (Obamacare) bankrupt insurance companies?

PPAC seems very similar in nature to the Community Reinvestment Act that played a role in the 2008 financial crisis. The PPAC requires insurers to offer the same premium (price fixing) to all applicants of the same age and geographical location without regard to most pre-existing conditions (excluding tobacco use). It also states that minimum standards for health insurance policies are to be established and annual and lifetime coverage caps will be banned. As a business owner, I don't see where the government comes to the conclusion that insurance companies could survive the price fixing and taking on such high risk liabilities. It seems like 2008 all over again, does it not? Wouldn't they get involved in something similar to what the banks did with derivatives since they were forced to take on high risk loans? It seems like the big focus on Obamacare is the part where people are forced to buy insurance. I don't think that is a big issue, the big issue is how can the insurance companies handle this? Am I wrong? I am going to do more research tonight.

I have a vehicle which was totaled. Insurer is Progressive. I live in WA, so the adjuster is not allowed to use NADA or KBB to determine value. He's supposed to provide fair market value. He got two estimates, both of which seem very low to me--less than half the replacement cost of a vehicle from the same year in the same condition. I've asked whether I can submit Craigslist listings from my half of the US to prove the value is higher. He says any documentation must be from within 150 miles of my home, which puts me at a disadvantage since I live in a rural area. I'm wondering: 1) Is my insurance company obligated to accept competitive estimates of value in determining my vehicle's value if I can find local shops that determine that the value is higher? 2) What mechanisms are in place to ensure that value estimates made by dealers are accurate, and can a dealer's estimate of value be disputed? 3) What other options do I have if my adjuster refuses to budge on value?

A little over a week ago i bought a 2006 honda civic from a honda dealership. While driving i hit a rather large pothole that i guess put a hole in the radiator. I got out to check for damage didn't see anything no smells, didn't see anything leaking figured i would continue to drive home. While on my way the car was driving completely normal but stalled out. Apparently the engine overheated and now when the car starts it sounds horrible and stalls if you put it in drive. The car is under the most protection the insurance company offers but someone said that they wont cover the engine because I continued driving on it even though I didn't know that there was something wrong. After further examination The radiator actually got dented and hit one of the fans for the engine but theres no way to tell that unless you lift the car looking at it with the car being normal you cant tell it ever hit anything.
